TERMS OF SERVICE

Effective Date: May 24, 2026

Status: Active Legal Framework (Merged Operational Infrastructure Code)

Please read these Terms of Service (“Terms”, “ToS”) carefully before using the website, automated billing systems, account provisioning managers, or any server control panel environments (collectively, the “Service”) operated by Free Host India (“us”, “we”, or “our”).

By creating an account, deploying a website, or utilizing our infrastructure, you unconditionally agree to be bound by these Terms. If you disagree with any part of these terms, you are strictly prohibited from accessing the Service.

1. Eligibility, Identity Verification Waiver, & Account Security

No Identity Verification: The Service does not mandate real-world identity verification or student documentation during registration.

Single Account Limit: Users are strictly prohibited from registering multiple client profiles or hosting accounts to bypass resource allocations. Automated detection of multi-account profiles will result in the immediate termination of all associated assets.

Account Responsibility: Because accounts are unverified, you are exclusively responsible for safeguarding the credentials of your billing client area and hosting control panels. Any malicious activity traced to your account credentials will be treated as your direct action.

Age Requirement: You affirm that you are at least 13 years of age. If you are under 18, you affirm you are using this Service under the supervision of a parent or legal guardian.

2. Acceptable Use Policy (Prohibited Content & Activities)

Our infrastructure is provided strictly for legitimate educational, coding, and personal development projects. Websites must consist entirely of publicly accessible web pages. We enforce a zero-tolerance policy against platform abuse.

The following activities, content types, and services are strictly prohibited on our network:

Cyber-Attacks & Malicious Tooling

Denial-of-Service (DoS/DDoS): Engaging in, facilitating, or launching network disruption attacks, outbound or inbound.

Attack Scripts: Hosting or executing brute force tools, IP scanners, port checkers, proxy scripts, or mail bombers.

Exploits & Malware: Distribution, storage, or hosting of hacking material, cracking tools, exploits, standalone shells, botnets, or ransomware.

Digital Piracy & Media Storage Exploits

Pirated Materials: Distribution, indexing, or linking to warez, copyrighted MP3s, videos, torrents, or commercial media files.

Nulled Software: Hosting pirated, cracked, nulled, or illegally distributed software, including intentional GPL license misuse.

Streaming & Storage: Running movie streaming portals, massive upload/download portals, file-sharing sites, file dumps, mirror services, backup repositories, or ad servers.

Financial, Scam, & Crypto Schemes

Cryptocurrency Abuse: Any cryptocurrency-related activities, including background crypto-mining, hosting crypto trading platforms, wallet indexers, or executing crypto-jacking scripts.

Financial Scams: High-Yield Investment Programs (HYIP), lottery schemes, automated Autosurf platforms, matrix schemes, investment scams, and escrow abuse.

Commercial Fraud: Fake login interfaces, phishing pages, clone sites, and account trading or resale of your free hosting allocation.

High-Risk & Illegal Content

Adult Content: Pornographic, sexually explicit, porn-related, or child porn content (including indirect, mirrored, or externally linked adult content).

Indian Law Violations: Any content or behavior that is illegal under the Information Technology Act, 2000, or any active laws of the Republic of India.

Public Safety Threats: Material promoting criminal activities, or content threatening public safety (including data/manuals related to weapons, bombs, or illegal tactical gear).

Controlled Substances: Portals facilitating the unauthorized sale of controlled substances, illicit drugs, or unverified online pharmacies.

Resource & Communication Abuse

Spam & Mass Mailing: Deploying bulk email tools, spam-related services, or executing automated scripts for unsolicited communications.

Resource Overloads: Running high CPU, high memory, or resource-intensive applications (including chat scripts, cron-job loops shorter than 5 minutes, or automated scrapers) that impair network stability or degrade the environment for other users on the shared server cluster.

3. Absolute Discretionary Termination & Data Erasure

The Service reserves the complete, unilateral right to modify, suspend, restrict, or permanently delete any client account, website files, configurations, and databases from any of our hosting control panels at any moment.

No Notice Enforcement: Account suspension and deletion can and will occur automatically or manually without prior warning, without providing justification, and without right to appeal if any item in Section 2 is breached or if server resource safety parameters are triggered.

No Liability for Deletion: Free Host India is under no obligation to provide you with data downloads, site backups, or zip files after an account has been flagged and suspended for abuse.

Inactivity Cleanup: To optimize server hardware resources, any free-tier account displaying zero active visitor traffic or remaining completely unaccessed for more than 90 consecutive days will be automatically purged from our system permanently.

4. Complete Disclaimer of Warranty & Limitation of Liability

“As-Is” Provision: Free Host India provides all infrastructure, hosting space, and databases on an “as-is” and “as available” basis. We make no express or implied warranties regarding server uptime, connectivity, database stability, or file safety.

Data Loss Disclaimer: Under no circumstances shall Free Host India, its owners, or its server administrators be held liable for any direct, indirect, incidental, or consequential damages resulting from data loss, server migration errors, site corruption, hardware degradation, or permanent account deletions.

Mandatory Backups: It is exclusively the user’s responsibility to maintain independent, off-site local backups of all website files, codes, and database scripts.

5. Special Provisions for Paid and “Lifetime” Tier Accounts

Definition of “Lifetime”: The term “Lifetime Hosting” refers exclusively to the active operational lifespan of the Free Host India server infrastructure. It does not refer to the biological lifetime of the user. We reserve the right to safely discontinue infrastructure operations or retire legacy hardware arrays at any time under our sole discretion.

Shared Network Risks: Paid and lifetime tier users explicitly acknowledge that they are hosting assets on a shared infrastructure network that accommodates unverified, free-tier users. Free Host India accepts zero liability for any localized IP blacklisting, search engine optimization (SEO) drops, or mail delivery degradation caused by the unauthorized actions of third-party free users sharing the network footprint.

No-Refund Policy: All monetary transactions for lifetime tiers and add-ons are strictly non-refundable. Under no scenario—including total server loss, catastrophic data failure, or complete brand termination—shall the Service or its owners be liable for monetary refunds, damages, or financial compensation of any kind.

6. External Premium Brand Redirection

Independent Platforms: The Service provides automated links, comparison tables, and redirections to our separate, affiliated premium hosting brand for users requiring advanced commercial resources.

Legal Separation: The moment you redirect to our premium brand, you are departing from the Free Host India legal framework. Our paid premium brand operates under an entirely separate legal entity, Terms of Service, and Privacy Policy.

Zero Liability for Upgrades: Free Host India accepts zero legal, financial, or technical liability for any transactions, billing configurations, customer support disputes, or data management that occur once a user interacts with the paid external brand.

7. Law Enforcement & Statutory Compliance (India)

The Service operates under the regulatory jurisdiction of India and actively complies with the Information Technology Act, 2000, and all current CERT-In directives.

Log Preservation: To legally insulate the platform owners, all system logs, file transfer protocols, registration footprints, and IP histories are securely retained for a minimum of 180 days.

Immediate Disclosure: In the event of a cyber security incident, legal complaint, phishing report, or formal investigation from Indian law enforcement agencies or cyber-crime cells, Free Host India will immediately surrender all system logs, connection histories, and uploaded website code to authorities without requiring user notice, authorization, or consent.

8. Indemnification

You agree to fully indemnify, defend, and hold harmless Free Host India, its owners, operators, and network administrators from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from your use of the hosting platform, your violation of these Terms, or any content or scripts deployed to your directory.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access our client area or host files after modifications become effective, you agree to be bound by the revised terms.
